What Is Chapter 7 Bankruptcy?

Chapter 7 bankruptcy is a type of legal process that allows individuals and businesses to discharge or wipe out certain debts. It's essentially a liquidation process where a bankruptcy trustee takes possession of the debtor's non-exempt assets, converts them to cash, and distributes the proceeds to creditors. Exempt assets may be, with certain limitations, your primary residence, vehicle and personal belongings.

The discharged debt could be credit card debts, medical bills and personal loans. This means that once discharged, you do not need to pay these back. However, certain types of debt may not be discharged, such as taxes and student loans.

Individuals are generally eligible if their income is below the state median or they pass a means test.
